📋 Short version: Use Site CliniQ honestly, don't abuse our infrastructure, pay for what you use, and respect our intellectual property. If something goes wrong, our liability is limited to what you paid us in the last 12 months.

1. Acceptance of Terms

By downloading, installing, or using Site CliniQ ("the Plugin", "our Service"), or by visiting sitecliniq.com ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Service.

These Terms form a legally binding agreement between you ("User", "you") and Bilal Mahmood, the developer and operator of Site CliniQ ("we", "us", "our").

2. Description of Service

Site CliniQ is a WordPress plugin that scans WordPress sites for health issues including PHP errors, SEO problems, broken links, plugin conflicts, image issues, and more. Paid plans include AI-powered diagnosis features using Anthropic's Claude AI model.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. License & Permitted Use

Free Plugin: The free version of Site CliniQ is distributed under the GNU General Public License v2 (GPLv2), as required by WordPress.org. You may use, copy, and distribute it under GPL terms.

Pro / Paid Plans: A paid license grants you a non-exclusive, non-transferable right to use the Pro features on the number of sites specified in your plan. You may not:

  • Redistribute, resell, or sublicense paid features
  • Use a single-site license on more sites than permitted
  • Reverse-engineer, decompile, or attempt to extract the source code of proprietary components
  • Remove or obscure licensing, copyright, or attribution notices

4. Accounts & Registration

Some features require account registration through Freemius, our licensing platform. You are responsible for maintaining the security of your account credentials. You must provide accurate registration information and notify us immediately of any unauthorised access.

5. Payment & Billing

  • Paid plans are billed on a recurring monthly or annual basis through Freemius (powered by Stripe)
  • All prices are in USD unless otherwise stated
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel at any time from your Freemius account dashboard
  • Cancellation takes effect at the end of the current billing period - no pro-rated refunds for partial periods
  • We reserve the right to change pricing with 30 days' notice

6. Refund Policy

We offer a 30-day money-back guarantee on all paid plans. If you are not satisfied within 30 days of your initial purchase, contact us at hello@sitecliniq.com for a full refund. Refunds are not available after 30 days or for renewal charges.

7. AI Features & Third-Party Services

AI-powered features use Anthropic's Claude API. When you enable AI diagnosis with your own API key:

  • You are responsible for obtaining and maintaining your own Anthropic API key
  • Your usage is subject to Anthropic's Terms of Service and pricing
  • We are not responsible for the accuracy, availability, or cost of Anthropic's API
  • API calls are made directly from your server to Anthropic - we do not proxy or store AI responses

8. Acceptable Use

You agree not to use Site CliniQ to:

  • Violate any applicable laws or regulations
  • Scan sites you do not own or do not have explicit permission to scan
  • Attempt to circumvent license restrictions or access controls
  • Overwhelm our servers or licensing infrastructure with excessive requests
  • Upload malicious code or interfere with other users

9. Intellectual Property

The Site CliniQ name, logo, website design, documentation, and proprietary plugin code are owned by Bilal Mahmood. Nothing in these Terms transfers any intellectual property rights to you except the limited license granted in Section 3.

The free plugin code is licensed under GPLv2 as noted above.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated recommendations will be accurate or complete. Always review AI suggestions before applying changes to your site.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Bilal Mahmood and Site CliniQ from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service immediately if you violate these Terms, fail to pay fees when due, or engage in behaviour harmful to us or other users. Upon termination, your license to use the Plugin ends, but GPL-licensed components remain available under those terms.

14. Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or, where arbitration is not available, in the courts of Lahore, Pakistan.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email (for registered users) or by posting a notice on our website. Continued use of the Service after the effective date of changes constitutes acceptance.
